FLATHEAD RESERVATION — The CSKTMT Water Rights Compact is in effect. Most water users in the Mission Valley recently received a letter from the Montana DNRC that talks about the need to register water users.  The letter describes the process for registering a water use as a statelaw based water use. However, tribal members have the option to register their water use as part of the Tribal Water Right.

Eligible Tribal Water Right uses include but are not limited to groundwater development for stock water, domestic, commercial or industrial uses and historically irrigated allotments held in Trust that are not served by FIIP, or the Flathead Indian Irrigation Project.  

Water Uses registered with CSKT as part of the Tribal Water Right will have an 1855 priority date. Water uses registered with DNRC as a statelaw based water use may result in a more junior priority date depending on the date the water was put to use.  

A new Tribal Water Rights Registration Program housed in the Tribal Legal Department will assist Tribal Members with registering their existing use.
